1. Agreement and Acceptance
Welcome to AMT. The AMT website, eBay store, and all associated online platforms (collectively, the “Site”) are operated by AMT, also known as All Mint Trading (“AMT,” “we,” “us,” or “our”). By accessing the Site, creating an account, placing a bid, making a purchase, or submitting items for consignment, you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”) without modification. If you do not agree to these Terms, do not use the Site or our services.
These Terms constitute a legally binding agreement between you and AMT. Please read them carefully and retain a copy for your records.
2. Description of Services
AMT is an online auction and sales company specializing in sports cards, autographed memorabilia, trading cards, and collectible items (collectively, “Items” or “Memorabilia”). Our services include:
- Direct Sales: Sale of Items owned by AMT
- Consignment Sales: Sale of Items on behalf of third-party consignors through eBay auction and fixed-price listings
- Authentication Facilitation: Coordination with third-party authentication and grading services on behalf of clients
AMT operates primarily through eBay and may utilize additional online platforms at our discretion. All sales conducted through third-party platforms are additionally subject to the terms and policies of those platforms (including but not limited to eBay’s User Agreement, Buyer Protection policies, and Return policies).
3. Item Descriptions, Condition, and Photographs
3.1 Accuracy of Descriptions
AMT makes every reasonable effort to accurately describe the condition, authenticity, and characteristics of all Items listed for sale. Descriptions may include references to professional grading (e.g., PSA, BGS, SGC), condition assessments, provenance, and other relevant details.
3.2 Photographs
All photographs are of the actual Item being offered unless expressly stated otherwise (e.g., “stock photo” or “representative image”). Colors, textures, and fine details may vary slightly due to differences in monitors, screens, and photographic lighting. Minor variations between the photograph and the physical Item due to digital display limitations do not constitute a material misrepresentation.
3.3 Condition and Grading
Professionally Graded Items: Items that have been graded and encapsulated by a recognized third-party grading service (PSA, BGS, SGC, JSA, Beckett, etc.) are sold based on the grade assigned by that service. AMT does not independently verify or guarantee the accuracy of third-party grades. Any dispute regarding the grade of an encapsulated Item must be directed to the grading company.
Ungraded Items: Condition descriptions of ungraded Items (e.g., “Near Mint,” “Excellent,” “Good”) represent AMT’s good-faith assessment based on industry-standard terminology. Condition assessments are inherently subjective, and reasonable professionals may differ in their evaluations.
“As-Is” Items: Certain Items may be listed “as-is” with known defects or without a condition guarantee. Such Items are sold without any warranty as to condition.
3.4 No Guarantee of Value
AMT makes no representation or warranty regarding the current or future market value of any Item. The collectibles market is inherently volatile, and past sales prices are not indicative of future value. Buyers assume all risk regarding the investment value of purchased Items.
4. Auctions and Sales
4.1 Bidding
All bids placed on AMT auctions are binding offers to purchase. By placing a bid, you agree to purchase the Item at your bid price if you are the winning bidder. Bid retractions are permitted only in the limited circumstances allowed by the applicable auction platform’s policies.
4.2 Sales Tax
AMT collects and remits sales tax as required by applicable state and local law. Sales tax will be calculated and applied at checkout based on the shipping destination. Buyers claiming tax-exempt status must provide a valid exemption certificate prior to purchase directly on eBay.
4.3 Payment
Payment is due within seven (7) business days of the close of auction or completion of a fixed-price purchase unless otherwise stated. Accepted payment methods are those available through the applicable sales platform. Failure to remit timely payment may result in cancellation of the transaction, and/or restriction from future purchases.
4.4 Finality of Sales
All sales are final except as expressly provided in Section 6 (Returns) below, or as required by applicable law or the policies of the platform on which the sale was conducted.
5. Shipping, Handling, and Risk of Loss
5.1 Shipping Methods
AMT ships all Items using commercially reasonable carriers and packaging methods appropriate for the nature and value of the Item.
5.2 Shipping Costs
Shipping costs are as stated in the listing or calculated at checkout. AMT reserves the right to select the shipping method and carrier unless a specific method is agreed upon in advance.
5.3 International Shipping
International Buyers are responsible for all customs duties, import taxes, brokerage fees, and any other charges imposed by their country of destination. AMT is not responsible for delays caused by customs processing.
5.4 Consignor Shipments to AMT
AMT is not responsible for any packages shipped directly to us by consignors that are lost, stolen, delayed, or damaged in transit. Risk of loss for all Items shipped to AMT by a consignor remains with the consignor until the package is physically received and inspected by AMT staff at our facility.
Consignors are strongly encouraged to:
- Use a trackable shipping method with signature confirmation required
- Purchase carrier insurance for the full declared value of the Items being consigned
- Package Items appropriately for their nature and value
- Retain all shipping receipts, tracking numbers, and insurance documentation
AMT will not be liable for any claim arising from damage or loss that occurs during transit from the consignor to AMT, regardless of the carrier used. Any insurance claims for lost or damaged Items in transit must be filed by the consignor directly with the carrier or insurer.
6. Returns and Disputes
6.1 General Return Policy
Due to the unique nature of collectible Items, all sales are final unless:
- The Item is materially not as described in the listing (e.g., wrong Item shipped, significant undisclosed damage, incorrect grading attribution);
- The Item is determined to be counterfeit by a recognized third-party authentication service; or
- A return is required by the applicable platform’s buyer protection policies or by applicable law.
6.2 Return Procedure
To initiate a return under Section 6.1, the Buyer must:
- Open a return request on eBay within three (3) days of receipt of the Item;
- Provide photographic evidence of the claimed deficiency or misrepresentation;
- Return the Item in the same condition and packaging in which it was received; and
- Ship the return using a trackable shipping method.
6.3 Refunds
Approved returns will be refunded via the original payment method within ten (10) business days of AMT’s receipt and inspection of the returned Item.
6.4 Items Not Eligible for Return
The following Items are not eligible for return except in cases of proven counterfeit or material misrepresentation:
- Items sold “as-is”
- Items damaged by the Buyer after receipt
- Items for which the packaging or grading case has been opened or tampered with
- Items where the Buyer’s dissatisfaction is based solely on subjective condition assessment
6.5 Platform Dispute Resolution
If a sale is conducted on eBay or another third-party platform, the dispute resolution procedures of that platform may apply in addition to or in lieu of these Terms. AMT will cooperate with platform dispute resolution processes in good faith.
7. Authentication and Provenance
7.1 Third-Party Authentication
Where an Item is described as authenticated by a third-party service (e.g., PSA, JSA, Beckett Authentication), AMT is relying on and passing through the certification of that service. AMT does not independently guarantee the authenticity of Items certified by third parties.
7.2 Items Without Third-Party Authentication
Certain Items may be offered without third-party authentication. Such Items will be clearly identified, and any representations regarding authenticity are based on AMT’s good-faith assessment, provenance documentation, or the representations of the consignor. Buyers are encouraged to obtain independent authentication for unencapsulated autographed Items.
7.3 Counterfeit Items
AMT does not knowingly sell counterfeit Items. In the event that an Item sold by AMT is subsequently determined to be counterfeit by a recognized authentication service, AMT will, at its option:
- Refund the purchase price upon return of the Item; or
- Replace the Item with a comparable authentic Item, if available.
This remedy is available for a period of thirty (30) days from the date of delivery and constitutes the Buyer’s sole and exclusive remedy for counterfeit claims, except as otherwise required by applicable law.
8. User Accounts
8.1 Account Registration
Certain features of the Site may require account registration. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
8.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You agree to notify AMT immediately of any unauthorized use of your account.
8.3 Account Termination
AMT reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice, including but not limited to cases of non-payment or repeated late payment, bid manipulation or shill bidding, harassment of AMT staff or other users, submission of counterfeit Items for consignment, or violation of any provision of these Terms.
8.4 Age Requirement
You must be at least eighteen (18) years of age to use the Site, create an account, bid on Items, or make purchases. If you are under 18, you may use the Site only under the direct supervision of a parent or legal guardian who agrees to be bound by these Terms.
9. Intellectual Property
All content on the Site — including text, photographs, graphics, logos, page layout, and software — is the property of AMT or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without the express written permission of AMT.
Photographs of Items listed for sale are the property of AMT and may not be used by third parties without written permission.
10. Privacy and Data
10.1 Information Collection
AMT collects personal information necessary to process transactions, communicate with users, and operate the Site. This may include name, address, email, phone number, payment information, and transaction history.
10.2 Use of Information
Your information will be used solely for the purposes of operating the Site, processing transactions, communicating with you regarding your account or purchases, and as required by law. AMT will not sell your personal information to third parties.

11. Consignment Terms
11.1 Overview
This Section governs the relationship between AMT and any person or entity (“Consignor”) who submits Items to AMT for sale on a consignment basis. By submitting Items for consignment, the Consignor agrees to be bound by the terms of this Section in addition to all other applicable provisions of these Terms.
11.2 Item Submission and Acceptance
Consignors may submit Items for consignment subject to AMT’s review and acceptance. AMT reserves the right, in its sole discretion, to refuse any Item it determines to be:
- Counterfeit, forged, or of questionable authenticity
- Unsellable due to condition, subject matter, or lack of market demand
- Misrepresented by the Consignor at the time of submission
- Below AMT’s minimum value threshold for consignment
Items refused at intake will be returned to the Consignor at the Consignor’s expense within fourteen (14) days of the refusal determination.
11.3 Consignor Representations and Warranties
By submitting Items for consignment, the Consignor represents and warrants that:
- The Consignor is the lawful owner of all submitted Items, or has full legal authority to consign them on behalf of the owner;
- All submitted Items are free and clear of any liens, encumbrances, claims, or legal disputes;
- No submitted Item is stolen, fraudulently obtained, counterfeit, or otherwise unlawfully acquired;
- All representations made to AMT regarding the authenticity, provenance, and condition of submitted Items are true, accurate, and complete to the best of the Consignor’s knowledge; and
- The Consignor has the full right, power, and authority to enter into this consignment relationship.
The Consignor agrees to indemnify, defend, and hold harmless AMT, its owners, officers, employees, and agents from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from any breach of the representations and warranties set forth in this Section.
11.4 Consignment Fees and Commission
AMT will retain a commission from the gross sale price of each Consigned Item sold. The commission rate and any additional fees (including but not limited to third-party grading or authentication fees, platform selling fees, and return shipping costs) will be based on the fee structure provided to the Consignor on AMT’s website, as may be updated from time to time. All applicable fees will be disclosed to the Consignor prior to any Item being listed for sale.
11.5 Listing and Pricing Authority
The Consignor grants AMT full authority to photograph, describe, list, market, and sell Consigned Items on eBay, AMT’s website, and any other online or offline sales platform at AMT’s discretion. AMT may set opening bid prices, reserve prices, or fixed sale prices. If the Consignor wishes to establish a minimum sale price for any Item, such minimum must be agreed upon in writing prior to listing. AMT will not sell a Consigned Item below the agreed minimum without the Consignor’s written consent.
All photographs taken by AMT of Consigned Items are the property of AMT. By submitting Items for consignment, the Consignor grants AMT an irrevocable, royalty-free license to use such photographs for listing, marketing, and promotional purposes.
11.6 Consignment Period and Unsold Items
Unless otherwise agreed in writing, the initial consignment period is ninety (90) days from the date of intake. At the conclusion of the consignment period, AMT will notify the Consignor of any unsold Items. The Parties may agree in writing to extend the consignment period. If no extension is agreed, unsold Items will be returned to the Consignor at the Consignor’s expense within thirty (30) days of notification.
11.7 Consignor Payment
Once a sold Item’s funds have cleared and any applicable platform hold periods have expired, the proceeds will be made available to the Consignor through AMT’s customer portal. Consignors are responsible for initiating payout requests through the portal. AMT will process approved payout requests within three (3) business days of the request being submitted, provided that the funds associated with the requested amount are available and no pending disputes, returns, or chargebacks exist with respect to the applicable sale. Payment will be made via the payout method on file in the Consignor’s portal account. The Consignor is responsible for providing and maintaining accurate payout information in the portal, and AMT shall not be liable for any delayed or misdirected payments resulting from inaccurate or outdated payout information provided by the Consignor.
In the event that a buyer returns a Consigned Item or initiates a chargeback or platform dispute that results in a refund being issued, the Consignor agrees that the previously remitted payment (or the applicable portion thereof) shall be deducted from future proceeds, or if no future proceeds are available, repaid to AMT within thirty (30) days of written notice.
11.8 Storage and Care of Consigned Items
AMT agrees to exercise reasonable care in the handling, storage, and safekeeping of all Consigned Items while in its possession. AMT shall not be liable for loss or damage caused by circumstances beyond its reasonable control, including but not limited to fire, flood, natural disaster, or acts of God. In the event of theft or vandalism, AMT’s liability shall be limited to instances where AMT failed to exercise reasonable security measures, and shall in no event exceed the Consignor’s declared value of the Item at the time of intake. AMT does not insure Consigned Items on behalf of Consignors. Consignors are strongly encouraged to maintain their own insurance coverage for Items while in AMT’s possession.
11.9 Shipping — Consignor to AMT
AMT is not responsible for any packages shipped directly to us by consignors that are lost, stolen, delayed, or damaged in transit. Risk of loss for all Items shipped to AMT by a consignor remains with the consignor until the package is physically received and inspected by AMT staff at our facility. See Section 5.4 for consignor shipping obligations.
11.10 Abandoned Property
If a Consignor fails to respond to AMT’s communications regarding unsold Items for a period of ninety (90) days following written notice sent to the Consignor’s last known email or mailing address, such Items shall be deemed abandoned. AMT reserves the right to donate, auction, or otherwise dispose of abandoned Items after this period without further obligation to the Consignor. AMT shall retain any proceeds from the disposition of abandoned Items as compensation for storage and administrative costs.
11.11 Right to Reject and Terminate
AMT may terminate a consignment relationship at any time with written notice. Upon termination, AMT will return all unsold Items to the Consignor within thirty (30) days at the Consignor’s expense, and will remit all outstanding payments for sold Items within fourteen (14) days, less any outstanding fees or deductions. Items actively listed at the time of termination may remain listed until the listing period expires, unless otherwise agreed.
12. Limitation of Liability
To the maximum extent permitted by applicable law, All Mint Trading, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, any transaction conducted through the Site, or any Item purchased or consigned through All Mint Trading, including but not limited to damages for loss of profits, loss of value, loss of data, or business interruption, regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if All Mint Trading has been advised of the possibility of such damages.
All Mint Trading’s total aggregate liability arising from or related to any transaction shall not exceed the purchase price of the specific Item that is the subject of the claim.
The Site, all Items, and all services are provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
13. Indemnification
You agree to indemnify, defend, and hold harmless AMT, its owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or services; (b) your breach of these Terms; (c) your violation of any applicable law or regulation; (d) any dispute between you and a third party arising from a transaction conducted through AMT; or (e) any claim that Items you consigned to AMT are counterfeit, stolen, misrepresented, or infringe the rights of any third party.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal proceeding, the parties agree to attempt to resolve any dispute arising under these Terms through good-faith negotiation for a period of thirty (30) days following written notice of the dispute.
14.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or any transaction conducted through AMT that is not resolved through informal negotiation shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration shall be conducted in the state of Michigan, or at another mutually agreed location. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
14.3 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against All Mint Trading.
14.4 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of laws provisions.
14.5 Small Claims Exception
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the jurisdictional limits of such court.
15. Links to Third-Party Sites
The Site may contain links to third-party websites, including but not limited to eBay. AMT is not responsible for the content, privacy practices, or terms of use of any linked third-party site. Inclusion of a link does not constitute endorsement by AMT.
16. Electronic Communications
By using the Site, creating an account, or conducting a transaction with AMT, you consent to receive electronic communications from us, including transaction confirmations, shipping notifications, account updates, and legal notices. You agree that electronic communications satisfy any legal requirement that such communications be in writing.
17. Force Majeure
AMT shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, government actions, carrier delays, power failures, or internet disruptions.
18. Modifications to Terms
AMT reserves the right to modify these Terms at any time. The most current version will be posted on the Site with the effective date. Your continued use of the Site after any modification constitutes acceptance of the revised Terms. Material changes will be communicated via email or Site notification.
19. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
20. Entire Agreement
These Terms constitute the entire agreement between you and AMT with respect to the Site and all transactions conducted thereon, and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
